Fotoccasion respects copyright and expects users to upload only content they have the right to share. We respond to notices that comply with the Digital Millennium Copyright Act (17 U.S.C. § 512).

Reporting infringement (takedown notice)

Send a notice to our designated agent:

Your notice must include: (1) your physical or electronic signature; (2) identification of the copyrighted work; (3) identification of the infringing material and information reasonably sufficient to locate it (an event code plus a description or screenshot of the photo/video works); (4) your contact information; (5) a statement of good-faith belief that the use is not authorized by the owner, its agent, or the law; and (6) a statement, under penalty of perjury, that the notice is accurate and you are authorized to act for the owner.

On receipt of a valid notice we will remove or disable access to the material promptly and notify the uploader.

Counter-notice

If your content was removed and you believe that was a mistake or misidentification, you may send a counter-notice to the same agent including: your signature; identification of the removed material and its prior location; a statement under penalty of perjury of good-faith belief the removal was mistaken; your name, address, phone; and consent to the jurisdiction of the federal district court for your address (or, if outside the U.S., [DISTRICT]). If the claimant does not notify us of a court action within 10–14 business days, we may restore the material.

Repeat infringers

We terminate the accounts of repeat infringers in appropriate circumstances.

Misrepresentations in notices or counter-notices can carry liability under 17 U.S.C. § 512(f).
